Terms and Conditions

When using the website, creating a profile and/or completing a reservation through Dive Adventure Travel you agree to have read, understood and agreed to the terms and conditions, explained in the following. Please read the information carefully.

 

Booking

– Dive Adventure Travel is an agent and charges a fee accordingly to the operator. The reservation forms an agreement between the guest and the operator, not between Dive Adventure Travel and the guest/customer. 

– Reservations are made online through the website www.diveadventure.travel and are subject to the availability of the requested product of the operator.

– We will not charge you any fees for our reservation service. Suppliers pay a commission to us when you make a reservation with them through our website.

– Dive Adventure Travel will handle the reservation process with the operator, but we are not responsible for the products offered by the operator.

– After the booking is confirmed and paid, Dive Adventure Travel will ask you for further information, that is needed by the operators (this can be, but not limited to passport copies, evidence of dive/travel insurance, health certificates, flight details, etc.) If the information is not sent by the guests, we hold the right to cancel the reservation according to the applicable booking policy. 

– In case a guest needs assistance whilst their trip, we will do our best to help but we are in no situation responsible for such services.

 

Booking Process

1. Step: To send a booking request, it is necessary to sign up on www.diveadventure.travel with an email address and a password.

2. Step: Guests choose a dive trip, offered on our website and fill out the booking form, including all required information. You will receive a pre-information email with your booking number and booking details. Please don´t book any flights until you receive the confirmation email with the link for the payment options from our team.

3. Step: After the operator confirmed the booking, you will receive another email with a link to the payment options.

4. Step: When your payment is finished, we will send you the final booking confirmation by email. Your reservation is now complete. The Booking confirmation email serves both as proof of your booking and as an invoice for your administration. 

5. Step: To collect all the guest information for the operators of the trip (including but not limited to, passport copies, evidence of dive/travel insurance, health certificates, flight details, etc.), we will send you further emails or in some cases, the operator will communicate directly with you.

 

Payment Process

– Dive Adventure Travel will confirm a booking when full payment is received. The full amount is due on the date of reservation.

– Guests can pay online by PayPal or with a bank transfer. We are not responsible for any additional fee your bank or credit card provider might charge you for this transaction. After your booking request is confirmed by the operator, we will send you an email with the payment link.

– In case of an incomplete payment (such as credit card chargebacks and or non-OUR bank transfers) Dive Adventure Travel reserves the right to charge the costs incurred to the customer.

– Dive Adventure Travel is not responsible for the service of our payment partners like PayPal or any bank that is used for the bank transfer.

– All our rates are charged in USD.

– We will not charge you any additional credit card or payment fees to complete your booking.

– Any refund will always be made in the same currency as the original payment you made.

 

Special Requests

– Special requests (rental gear, special dietary requests, specific extra cabin facilities, (dive) courses requested, activities requested and more) of the guests can be made in the booking form. Dive Adventure Travel will send these requests to the operator during the booking process. Further organization will be made between the guest and the operator. Dive Adventure Travel is in no situation responsible for the availability or condition of special requests.

– For airport/hotel pickup, we ask our guests to contact the operator directly to confirm the flight number, arrival time and meeting point.

 

Duties of the guest

– Customers must meet all passport-, visa- and health requirements of the country they are traveling to. Please review recent travel prohibitions, warnings, announcements and advisories issued by your government prior to departure. You should also inquire about vaccination and prevention of tropical ailments with a doctor and follow their advice. Dive Adventure Travel can´t give medical advice.

– The customers are themselves responsible for transportation to and from the boat. Operators may organize a free or charged transfer from airports or hotels nearby. Please contact the operators directly to organize a transfer.

– You must meet the health and disability requirements for a diving trip, defined by the operator. The operator may require to fill out health care forms to ensure guests are fit for diving. We recommend doing a health checkup by a doctor before your diving trip. Please notify us at the time of booking of any physical or mental illness, disability or other conditions for which special accommodations or the use of a wheelchair is necessary.

– To participate in diving activities a dive certification by organizations such as PADI or SSI is mandatory to make sure you have all the necessary skills. Operators may require a minimum certification level and a minimum number of logged dives as conditions on a diving trip can be difficult. Please make sure you meet those requirements. If you are unsure about the requirements, please contact us.

– Dive Adventure Travel recommends guests purchasing a dive and travel insurance that covers unforeseen circumstances and adventure travel-related risks to be protected in case of dive/sports accidents or any unexpected events or circumstances. Dive Adventure Travel doesn’t offer any kind of insurance, customers are responsible for purchasing their own travel and dive insurance.

– The rules of the operators must be respected by the guests. The operator (or captain) has the right to deny entry on board, deny diving activities or any of the activities offered by the operator if the rules are broken by a guest.

– If the guest’s arrival is delayed in transit and they fail to reach the boat by the scheduled time of departure, the guest will be responsible for all costs involved in catching up with the boat (should this be possible). That also includes staying at onshore accommodations and alternative diving arrangements etc. To avoid this situation, we recommend guests travel at least a day earlier than the departure date.

 

Cancellations

– For different liveaboard operators, different cancellation policies may apply for guests. Guests need to agree with the specific booking conditions.

– Operator policies may change in case of Force Majeure events.

If a guest wants to make a booking amendment Dive Adventure Travel will help to find a suitable alternative trip.

– No show for or early departure from a trip is considered to be the same as a cancellation after departure. In that case, no refund applies to the customer.

– In case of a (partial) refund due to a cancellation, we will apply a 3% administration fee to cover our credit card, bank transfer, and/or handling costs incurred, in addition to the cancellation policy of the operator (1. bullet point in paragraph 6. Cancellation & Amendments). This fee is calculated on the final price of the reservation.

– Cancellations always need to be submitted by email to info@diveadventure.travel to avoid misunderstanding.

– Sometimes an operator needs to change the boat because he depends on maintenance schedules (dry-dock) in their operating country. In this dry-dock schedule, delays may occur. In that case, the operator has the right to change the boat for the same booked itinerary. The guests have to accept the change of vessel. If the standard of the vessel lacks important facilities compensation can be made, but this is not an obligation. 

– The operator has the right to replace the vessel for already planned itineraries. Guests have to accept these changes as long as the vessel offers similar standards as the liveaboard that was initially booked. The operator can also change the cabin allocation depending on the availability and condition of the cabins. We will not be liable for those situations. 

– Should your trip be canceled or delayed by the operator, their policies will entitle you to reschedule the trip under the same conditions. Lengthened trips have no extra charge. Rescheduled or delayed trips are not subject to refunds. 

 

Prices

– Dive Adventure Travel guarantees to give you the lowest price that is available for your trip. If you find another website and/or agent providing lower prices than ours, contact us before your reservation and we will match the price or even create an even cheaper deal for you. 

– Special membership rates, loyalty programs or if the other agent doesn’t display rates before you have requested them, our best price guarantee doesn’t apply. 

– To get this deal, you need to provide us all details of the other offer including a link to the website where it can be found. The offer should be for the same product (boat, dates, cabins, itineraries, booking conditions, amenities, etc.). If any aspect of the offer is different, we can not create this deal for you.

– Prices and availability on our website are accurate in most cases. However, sometimes the operator may not have updated the correct information on dates and availability and prices in the database. We cannot be held responsible for that. We will do our best to ensure you will get the best price available.

 

Complaintments

– In case there is a problem with the service provided by the operator, the guest should speak to the captain of the boat immediately to solve the problem. Since Dive Adventure Travel only acts as an agent, we are not responsible for the product or service provided by the operators. 

– The law of the country in which the trip took place will apply to the relationship between the guest and the operator. Disputes between a guest and the operator will generally have to be settled by the court of the country in which the trip took place.

– In case you have a problem and you want to file a complaint, Dive Adventure Travel may help you if you tell us the details about your problem and provide a record of the complaint with facts (about when and with whom). If you receive a refund in that case, there will be a 5% administration fee deducted from the refund, to cover our operational costs.

– If you have a complaint about the service of Dive Adventure Travel like the website, payment process, or communication, please contact us directly. We will do our best to follow-up and create a better service for you in the future.

 

Liability

– The reservation forms an agreement between the guest(s) and the operator. Dive Adventure Travel only acts as a middle man and therefore cannot be held responsible for lack of service of the operator.

– Dive Adventure Travel cannot be held responsible for delays of flights and/or transfers.

– Dive Adventure Travel cannot be held liable for changes in vessel, cabin appointments or any other changes by the operator for the booked cruise. 

– We cannot be held accountable for wrong information published on partner websites.

– Dive Adventure Travel can never in any case hold responsible for unforeseen circumstances. Operators may ask you to sign a liability waiver before the trip or entrance on the ship may be refused.

– We will not be responsible for any losses you suffer (including missed flights). That applies also to personal injuries, property damage, or wrongful death that may occur during activities, like scuba diving, or any activity offered by the operator or as a result of acts or omissions of other third parties.

– We reserve the right to amend reservations in case this is deemed necessary. This can be the ship, the itinerary, or the cabin allocation. As long as the proposed alternative is of similar value the reservation is considered to be valid and thus Dive Adventure Travel will not be liable for any disputes arising from the change. 

– In case of Dive Adventure Travel is held responsible for mistakes in the reservation services provided, the maximum liability shall not exceed the amount charged to the operator for the service provided (e.g. the commission amount). 

– We and/or the operator are not responsible and cannot be held liable for delays, changes, or cancellation of service when the product cannot be executed partly or wholly owing to acts of God, political unrest as well as military or civil conflicts and terrorist activities, ‘force majeure’, or due to other circumstances that are unforeseeable or beyond the operator’s and our control.

– All information on our website is provided in good faith and is believed to be correct at the time of publication. Dive Adventure Travel will not be held responsible for any inaccuracies due to old information provided by the operators or partner websites.

 

Privacy

– Our policy regarding your privacy and how we use cookies on this website is written in our privacy policy.

 

Miscellaneous

– Dive Adventure Travel reserves the right to possible adjustments of prices and conditions.

– These Terms of Use shall be governed by US law and any dispute arising out of these Terms of Use and our services shall exclusively be submitted to the competent courts in Miami FL USA.

 

If any part of these terms and conditions becomes invalid, all other provisions are still applicable.
